On March 24, 2026, a jury in New Mexico imposed a civil penalty of $375 million on Meta for misleading users about the safety of Facebook, Instagram, and WhatsApp, and for allowing the sexual exploitation of children. On March 25, in Los Angeles, a judgment was issued ordering Meta and YouTube to pay a total of $6 million in damages for harmful designs targeting young users. These consecutive verdicts clearly cracked the atmosphere of "the law can't stop us anyway" that surrounds giant tech companies.

What is important about this shift is that the target of judgment was not the content itself, but the design that makes it difficult to stop using. In the Los Angeles lawsuit, the plaintiffs argued that endless feeds, autoplay, notifications, and mechanisms to retain young users were optimized based on children's brains and behavior. Plaintiff Kaley G.M. testified that she started using YouTube at age 6 and Instagram at age 9, spending her childhood "all day" on social media. The jury found that such designs and lack of warnings were a "substantial factor" in her harm.

This is also a decisive difference from conventional social media lawsuits. Section 230 of the U.S. Communications Decency Act has generally protected platforms broadly from liability for user posts. But this time, the central issue was not "did they show dangerous posts?" but "was it a product design that led to dangerous usage?" Therefore, the jury was able to shift away from the debate on freedom of expression and judge the responsibility of the companies for the interfaces they created. For social media companies, this is more painful than just a defeat. The thickest bulwark of their arguments is beginning to crumble.

Of course, the companies are fully contesting the verdicts. Meta argues that the mental health of young people is "extremely complex" and cannot be linked to a single app. YouTube also countered that it is a responsibly designed video distribution platform and that the plaintiffs' depiction is inaccurate. Both companies have indicated plans to appeal. According to Reuters, even on the day of the verdict, the stock prices of Meta and Alphabet slightly rose, suggesting the market still sees this as "not the final decision." However, even if the stock prices remain calm, the atmosphere in the courtroom has changed. The jury did not simply accept the companies' explanation that "it's too complex to pinpoint responsibility."

The families who have long been advocating for children's harm felt this change most keenly. In an AP interview, a father who lost his son to sextortion viewed the verdict as "closure," stating that "the industry has proven it cannot regulate itself." A mother who lost her daughter to drug purchases and revenge porn also mentioned that if accountability had been pursued earlier, the outcome might have been different. The verdict does not bring back the past. However, at least the explanation that "the harm is solely a family issue" or "a lack of parental supervision" is no longer sufficient.

Reactions on social media also reflect this change in atmosphere well. On X, the verdict became a trending topic and rapidly spread in the form of "Meta and Google ordered to pay $6 million" on summary pages. Furthermore, the tech watchdog group Tech Oversight Project positioned the verdict on X as a historic judgment shaking Big Tech's predatory business model. Journalist Lauren Feiner reacted on Bluesky, calling it a near "complete victory" for the plaintiffs, and Iain Mansfield welcomed it, saying it felt like "redoing tobacco litigation at high speed." In other words, on social media, there was a strong perception of this as a symbolic counterattack against giant platforms, rather than a standalone civil lawsuit.

However, reactions on social media are not all cheers. Mike Masnick of Techdirt expressed caution on Bluesky, stating that while he understands why many dislike Meta, this decision could weaken Section 230 and potentially set a bad precedent for the open internet. This is a point that cannot be overlooked. The need to protect children's safety and how far to extend platform responsibility are fundamentally separate issues. The more this lawsuit is welcomed, the next point of contention will shift to "where does dangerous design end and freedom of expression or neutral functionality begin?"

Nonetheless, the significance of the judiciary stepping in this far is substantial. As reported by AP and Reuters, the Los Angeles lawsuit is a bellwether case predicting the outcome of numerous related lawsuits, with over 2,400 similar cases consolidated in federal courts alone. In the New Mexico case, the second phase of the trial is scheduled for May 2026, where additional corrective orders or design changes for Meta may be discussed. In other words, this verdict is not the end but the beginning. If defeats accumulate from here, not only the scale of settlement payments but the very way products are made may change.

This trend is not confined to U.S. courts. According to Australia's ABC, the country's Communications Minister Annika Wells stated that the "drumbeat" over social media harm is growing louder following the verdict. In Australia, there is also progress in redefining services, including algorithms, infinite feeds, reaction metrics, and time-limited features. In short, what global policymakers are watching is not just "the content of the posts," but "the design philosophy of how long people are kept engaged with those posts."

Ultimately, the verdict poses one inconvenient question: Did children get hurt because they happened to encounter bad content, or because the product was designed to keep them encountering and unable to leave?
Until now, Big Tech has continued to answer that question with "it's complex," "it's not straightforward," and "it's a societal issue." But in March 2026, two juries demonstrated that this was not enough. The debate on protecting children's safety has finally shifted from "content management" to "design responsibility." Even though conclusions may waver in future appeals or additional trials, this shift in perspective is not something that can easily revert.
